'WHATAPISTOL': Houston firearms store makes custom Whataburger-themed gun

Quote
HOUSTON - People keep Whataburger order numbers, take Whataburger graduation, prom and baby photos, and now, order high-end guns with Whataburger insignia.

Chris Burling, a college student and gun enthusiast, purchased the tricked-out Whataburger look from HTX Tactical in north Houston. Burling, who posted photos and video of himself with the gun, and in front of a Whataburger, said the gun customization cost $1,800.

Can you say "Trademark dilution" lawsuit?
Wouldn't be the first time Texas based Whataburger went after trademark infringement / dilution, as these are the guys that don't allow open carry in their restaurants, and don't seem to like guns...

Maybe, maybe not. He isn't selling it. It is a private item. It may not be an issue, or they may not care.

I think the place he paid to do the work is more liable than he is, IMHO. But, he was dumb to tell everyone about it

No Copyright infringement as he is not using it for marketing and or promotion of business.

Same as if you really like coke and paint your car to look like a coke can. Personal use.

First of all, Whataburger is my favorite go to place for fast food burgers. But in NO way, am I going to do one of my guns in the Whataburger color scheme!  :scream3:

I see the guy has, IMO very much degraded the value of his gun by doing such a color scheme, if he ever decided  to sell it. Such a color scheme puts very large limiting factor on the number of people who would pay good money for it, and finding another person with his same eclectic tastes, that would pay top dollar, would be very difficult indeed.

Yes, I can see it's possible Whataburger could file a lawsuit for trademark infringement, but clearly a case for a judge to decide. I doubt the man is trying to promote or gain some sort of profit by doing such a color scheme on his gun in Whataburger's color scheme, but they might see it as different.

These guys are consistent, with a very solid quality product.  Some people poo poo fast food burgers, but as a made to order product, I don't really consider it "fast food" that's good, but good food that's fast.

What I like about Whataburger is their consistency. It doesn't matter which Whataburger I go to, and order a hamburger it's taste is the same at each and every one I have eaten at. That is also why for me Sonic comes in a close second for me as well.

And Whataburger is Texas founded, and based fast food chain. Their HQ is in Corpus Christie Texas!  :rocknroll2:

Orange is actually my favorite color - hence the color of this forum (I picked that).

Anyway, I always loved the color of this official HK USP in Orange. Back when I had a USP, I considered sending it off to get it refinished to match. But, I never did.

The gun is supposedly in the HK vault at their US headquarters

From reading the article,, this custom gun shop IS selling guns with all kind of companys, and sports teams logo's.
The rapper posted his picture with a custom gun he bought off the custom shop,  they built, it with Houston Rockets logo's on it. And they sold it to him.

Is that custom whataburger AR15 just for show? I doubt it. They ALREADY sold the pistol with the Rockets logo's.

Thats begging for a lawsuit.

Why would anyone be so stupid to think they could get away with that without being sued.  :thinker:
