Shipwreck,

You do NOT have to like me personally OR what our grad school professor, who was a very senior LSU Law school professor (who specialized in commercial law, which is why I took his courses, which have  direct effects upon our family's various commercial businesses) & Associate Dean of the Law School, stated. = I simply reported the facts of our grad school courses' case studies, as presented to our class.
(Given enough time, I can likely find the "hand outs" from the 3 courses of his that I completed, which included the SCOTUS majority's decision. = NOT MY WORDS but rather the case citation by the professor of the law school & based upon the SCOTUS' decision  in the newspaper case.)

BAN ME or DO NOT BAN ME,  but the (wrongly decided, imo)  decision of the SCOTUS remains "the law of the land", until/unless the decision is reversed or the decision is vacated. - In any case, I spoke the TRUTH & am certainly NOT on this forum to be "popular", at the cost of my personal honesty/honor.
(I'm pleased that you aren't getting paid, as if the forum's owners get sued, you are LIKELY not liable for civil damages.)

TXAZ,

I strongly suspect that when the case is appealed to a higher federal court (and it is my best estimate/opinion that the case WILL be appealed), the appeals court will strike down the lower court's decision as a violation of freedom of expression/The First Amendment.
(The SCOTUS has already decided that instructions on making incendiary & explosive devices IS lawful & the information may NOT be restricted from publication or being broadcasted in any public forum. = The first case involved THE ANARCHIST'S COOKBOOK, that published fully-functional & precise instructions for constructing/employing IED. = We peaceful & law-abiding citizens may not like the decision at law at all but that's the law of the land, until/unless the case precedents are reversed by the SCOTUS.)

Shipwreck,

SORRY but you are DEAD WRONG as regards "offensive speech" in a private business (It has ZILCH to do with "government") & any private agreement to join this (or any other forum) is VOID & "of no effect" at civil law, as such agreements are contrary to precedents in case law.
Actually, HAVING such a requirement to join the forum would be admitted in evidence as "a statement against defendant's interest", as like posting a "BEWARE OF DOG" sign indicated your fore-knowledge that the dog was dangerous or  in this present discussion that the forum is "intentionally intended to discriminate against the rights of members" at law.

In the case that I mentioned, the decision was decided against a FL newspaper, which claimed that, as a privately-owned business, that they had the right to censor speech that was printed in their opinion columns & "letters to the editor". = The federal courts in each level found against the newspaper & awarded damages to the plaintiff.

ALL that is necessary for the owners of this forum to be found liable for violation of an individual's right to free expression is for one person's offensive speech to be censured & then choose to sue the forum/owners.
(In the case of this forum, it would very likely be a LEFTIST activist that joins for the sole purpose of doing something REALLY hateful/racist/vulgar, getting censured for those comments by "management" & then going to court. - Any number of "public interest" law forms/organizations, like the SPLC or ACLU would love to prosecute such a case.)

Fwiw, while I am NOT a lawyer, we studied these "freedom of speech cases" all semester in Business Law 503,  when I was in grad school & I've given you a legitimate summary of what the district, appeals & SCOTUS decided.
Note: One thing that I find DISGUSTING & UNJUST is that NO liberal public forum/publication/public accommodation will likely ever be found to have violated the rights of a conservative BUT the federal courts would certainly find for the plaintiff, if it's a LIB/LEFTIST, who "feels offended" & chooses to sue the forum.

The safest thing for the owner(s) of this forum  to do
to avoid any civil exposure is to remove the requirement to  agree to the "rules" and THEREAFTER  remove the sub-forum altogether OR for the owners to purchase liability
insurance against such an unpleasant court result if sued.

To All,

According to the NWS, we have had NO measurable precipitation in nearby zip codes since June.

Tomorrow, the forecast say that we MAY have HEAVY RAIN. ====> Let's HOPE that the forecast is correct.
(We surely could use 2-5 " here, as our aquifer is DOWN to a low level for JUL.)

Shipwreck,

ImVHO,  FREEDOM OF SPEECH is primary here & everywhere else that is a PUBLIC ACCOMODATION.
(YES, this is such a public accommodation, as we are way too big of a forum to be a private conversation between a few members.)

IF it means that another moderator or more needs to be appointed to check the posts, so be it. - As Justice Thurgood Marshall said in an opinion in a case before the SCOTUS, "The remedy for offensive speech is more, rather than less, speech.  If we are to err as a society, I fall on the side of freedom of speech & expression, as long as no one is directly injured in the melee, by using 'fighting words'."
(The case was "on point", as it concerned "hate speech" in political expression.)

In another similar case, Justice Marshall said, "The First Amendment to our Bill of Rights does not exist to protect popular speech. Popular speech needs no protection in any forum. The First Amendment exists to protect citizen's Right to use & to  protect the expression of unpopular speech."

just my OPINION, satx

To All,

What would make such things easier would be to tie the TDL & LTC together at HQ, DPS, so that BOTH are updated with a simple change of address.

TXAZ,

As long as the IDIOT LEFT remains in  power in our capitol's government, I would suggest that the town & county be called:  LOONYTUNES town & MORON County.

MGimbo,

I was once, in the early 1990s, stationed in Baltimore & the STUPIDITY & insufferable ARROGANCE of the city's "leadership" has to be experienced to be believed.

CHL - Concealed Handgun License / Re: POLL: Concealed Carry in Church
« on: July 26, 2018, 10:13:54 PM »
Texas@last,

In well over 3 decades of carrying concealed essentially 24/365, I've NOT had to even once draw my handgun to defend anyone "off duty".
(I've been fully retired for about 12 years now but can still hit a 6" paper plate 8 or 9 times of 9 rounds with my APR1980-vintage Sig-Sauer P6 from the 25M line, so I'm little concerned about missing an evildoer  from an "inside the church distance", especially from "ambush" & a kneeling/supported position.)

Note: Our Baptist congregation has several men & at least, 2 women, who are KNOWN to our pastor/board of deacons to be CHL licensees & armed.

And YEP, after Daingerfield & Sutherland Springs, I'm concerned that ANY Texas church doesn't have armed/well-trained marksmen present in their services.
(In both massacres, the evident motive for the mass attack was HATRED of "churchgoing people".)
The monster of Daingerfield told the Morris County Master Jailer that he HATED "every sort of Bible-thumper" & was "sorry that he couldn't kill every one of them two-faced OBSCENITY DELETED".
In the aftermath of Sutherland Springs, the murderer's PC was found to have numerous comments about how much that he HATED all Christians & Jews & the outline of his murderous plan.

Texas@last,

Pastor,  ImVho, you are making a potentially FATAL error of judgement. - Before continuing to NOT carry your handgun on our person, may I suggest that you read the TEXAS MONTHLY article entitled, "The Blood of the Lamb" AND the book THE DAY THE ANGELS CRIED, by Larry Linam.

Fyi, I carry every time that I'm at church (& everywhere else that concealed carry is lawful), as I lost a pair of boyhood chums in THE DAINGERFIELD CHURCH MASSACRE.
(One of those GOOD men was a local police officer, who had been asked to NOT carry his revolver in church.)

Should it happen that a MONSTER comes into our church & fires a firearm and/or tries to use any other deadly weapon, I will try to ambush him (hopefully from a covered & concealed position) W/O warning & shed not ONE tear over his sudden death.

To All,

As I carry my Sig-Sauer 9mm everywhere that it is lawful to do so, BOTH Darla & I are covered by TX & NATIONAL LAW SHIELD.  We also have a LIABILITY POLICY RIDER on our renter's insurance policy.
(That rider covers us EXCEPT for INTENTIONAL/PREMEDITATED criminal acts.)

Nationwide coverage costs us about 13.oo a month & is cheap at 10X the price.

NO we do NOT work for the company. -  Instead we are just PAYING customers.

just our opinions, Darla & tex

To All,

No more needs saying that these three words:  SUTHERLAND SPRINGS, TEXAS.

BTW, I attended the BCSD's ACTIVE ATTACK training in China Grove, TX today. - "ACTIVE ATTACK" is the new "umbrella"  term for "Active shooter", i.e., Mass Murder & Terrorist Acts. = The term was changed to cover EXPLOSIVES, VEHICLES, TOXINS  & as well as attacks by BLADES.

Here in The Alamo City, we broke the all-time record for hot days on 3  of the last 4 days. The record was tied on the 4th day: 104. = 105 degrees at my place yesterday at 1600 & "not a leaf moving".
